Bail is granted to the applicant subject to a cash bond and specified conditions.

Summary

The Bombay High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, by Govind Subhash Nisal, who was charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023, the Arms Act, 1959, and the Maharashtra Police Act, 1951, for unlawful assembly and assault. Eyewitness testimony placed the applicant among the assailants, attributing to him the use of a stone and physical blows. The applicant, a 23‑year‑old married man with a young child and no prior criminal record, argued for release, emphasizing his lack of antecedents and the time already spent in custody. The court evaluated the seriousness of the alleged offences against the applicant’s personal circumstances and the principle of bail. It granted bail subject to a cash bond of Rs. 15,000, sureties, and a series of reporting and conduct conditions, while expressly reserving the right to revoke bail for any breach. The order was limited to bail and did not address the merits of the case.

Issues considered

  • What is the appropriate exercise of discretion under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in granting bail to an accused charged with unlawful assembly and assault?
  • Do the applicant’s personal circumstances (age, marital status, lack of antecedents, prior incarceration) justify bail despite eyewitness identification linking him to the crime?
  • Are the conditions imposed by the court sufficient to ensure the applicant’s attendance at trial and prevent tampering with evidence or witnesses?
