The court held that, given the applicant’s young age, student status, minor injuries to the victim, and the fact that most co‑accused were already on bail, bail under Section 483 is warranted.

Summary

The Bombay High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by Shrut Navnath Kulthe, a 22‑year‑old B.Com student accused in CR No. 229 of 2025 for multiple offences under the Bharatiya Nyaya Sanhita, 2023. The alleged incident involved a property dispute that escalated into a ruckus, causing only simple injuries to the shopkeeper. Eight of the ten co‑accused had already been released on bail, and the applicant had been in custody for over 14 months. The court noted the applicant’s youth, student status, and the minor nature of the injuries, and found no compelling reason to deny bail. Accordingly, the court granted bail subject to a cash bond of Rs. 10,000 and several conditions, without expressing any view on the merits of the case.

Issues considered

  • Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023
  • Whether the seriousness of the offences and the injury to the victim preclude bail
  • Whether the applicant’s age, student status and the bail status of co‑accused justify granting bail

              2. This is an Application under Section 483 of Bharatiya

Nagarik Suraksha Sanhita, 2023 seeking Bail in connection with C.R.

No.229 of 2025 registered with Adgaon Police Station for offences

              punishable under Sections 111(2), 111(3), 111(4), 109, 333, 351(3),

              352, 3(5), 55, 324(6) and 61(2) of the Bharatiya Nyaya Sanhita, 2023.

              3. Applicant is a young offender of 22 years of age and B.Com

student as argued by Mr. Deshmukh. He has been involved in the

present crime alongwith other co-accused. 8 out of 10 co-accused

persons have already been enlarged on bail. The victim has received

Application.

4. The dispute was between one of the other co-accused

persons and the shopkeeper in view of the property dispute where the

Complainant – First Informant was running his shop. Prima facie, it is

seen that the Accused persons were friends and therefore, they had

accompanied the principal accused person to the shop and had created

a ruckus.

5. The Applicant is incarcerated since 03.07.2025 for over 14

months. Considering the fact that he is a student and a young offender,

I am inclined to consider his case for grant of bail, even otherwise on

Thousand only) with one or two surety / sureties

                  of the like amount;

(iii) Applicant shall report to the Investigating Officer

                                                                        2 of 4

(iv) Applicant shall co-operate with the conduct of

trial and attend the Trial Court on all dates,

unless specifically exempted and will not take any

(viii)Any infraction of the conditions shall entail

cancellation of bail granted to the Applicant.

7. It is clarified that the observations made in this order are

limited for the purpose of granting Bail only and I have not made any

                                                                   3 of 4
