Holding

The Court allowed the withdrawal of the bail application and granted liberty to file a fresh application if circumstances change.

Summary

The applicant, Abhijeet Maruti Patil, filed a criminal bail application seeking release under Section 483 of the Bhartiya Nagarik Suraksha Sanhita (corresponding to Section 439 of the CrPC) for offences under sections 103(1), 238, 311 and 3(5) of the B.N.S. 2023. While the matter was being heard, the applicant's counsel, Mr. Satyavrat Joshi, requested a brief adjournment to consult the client. Subsequently, the counsel sought leave to withdraw the bail application, stating that a fresh application could be filed before the trial court if circumstances changed. The State's counsel did not oppose the withdrawal.
