The Court granted bail to the accused on the ground of long incarceration and violation of the right to a speedy trial, subject to strict conditions.
Summary
The Bombay High Court, Kolhapur Bench, considered a bail application filed under Section 483 of the BNSS 2023 by Ajit Balaso Patil, accused of murder and attempted murder under Sections 302 and 307 IPC. The accused had been in custody since September 2018, with the trial still pending and only eight of the 28 prosecution witnesses examined. The State argued the seriousness of the offence, while the defence highlighted the prolonged detention and alleged violation of the right to a speedy trial. The Court found that the length of incarceration justified indulgence and granted bail, imposing a monetary bond and several reporting and conduct conditions. The bail order was issued with directions for compliance and provision for cancellation upon default.
Issues considered
- The applicability of Section 483 BNSS 2023 to grant bail in a murder case on the ground of prolonged detention.
- Whether the accused's right to a speedy trial has been infringed sufficient to warrant bail.
- Whether bail can be granted despite the seriousness of offences under Sections 302 and 307 IPC.
