Bombay High Court

ASLAM GAFUR SAYYADversusSTATE OF MAHARASHTRA

Decided

Holding

The court held that the applicant is entitled to bail subject to conditions to prevent interference with the trial.

Summary

Advocate Aslam Gafur Sayyad applied for regular bail in a case where he is accused of preparing false and forged documents to provide surety and impersonating a surety before the trial court. The prosecution argued that he is the main culprit and could abscond or influence witnesses if released. The defense highlighted that co‑accused facing similar charges have been granted anticipatory bail, the applicant has no prior criminal record, and he has been in custody for over fourteen months pending trial. The court noted the similarity of allegations to those of the co‑accused, the applicant's clean antecedents, and the pending nature of the trial. Accordingly, the court granted bail on condition of a personal bond of Rs. 25,000 with sureties, and imposed conditions to prevent tampering with evidence or influencing witnesses.

Issues considered

  • Whether the applicant, an advocate accused of forging documents and impersonation, is entitled to regular bail.
  • Whether the risk of the applicant tampering with evidence or influencing prosecution witnesses justifies denial of bail.
  • Whether the bail granted to co‑accused facing similar charges is relevant to the applicant's bail application.
