The applicant is entitled to bail under Section 479 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The High Court of Bombay, Kolhapur Bench, considered an application for bail filed by Asif Aslam Mulla under Sections 483 and 479 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with offences under Sections 420, 406 (read with 34) of the IPC and Sections 3 and 4 of the MPID Act. The applicant had been in custody for over four and a half years, exceeding half of the maximum seven‑year sentence prescribed for the charges. The State did not dispute the facts or the period of detention. The Court held that the applicant is entitled to the benefit of Section 479 BNSS 2023, which allows bail when the accused has served more than half the maximum term, and granted bail subject to standard conditions. The order was made without evaluating the merits of the case, merely extending the statutory bail provision.

Issues considered

  • Whether bail can be granted under Section 479 of the Bharatiya Nagarik Suraksha Sanhita, 2023, when the accused has served more than half of the maximum sentence.
  • Whether the BNSS 2023 bail provision applies to offences punishable under the IPC and the MPID Act.
