Bombay High Court

RUTUJA VIRENDRASINH KATKARversusSTATE OF MAHARASHTRA AND ANR.

Disposal
Disposed off as Withdrawn

Holding

The bail application is allowed to be withdrawn, and the applicant may file a fresh bail application within five days, with the trial court directed to dispose of it expeditiously.

Summary

The applicant, a 25‑year‑old law graduate, filed a criminal bail application (No. 736 of 2026) before the trial court prior to the filing of the charge‑sheet. After the charge‑sheet (Crime No. 423 of 2026) was filed, the applicant sought to withdraw the pending bail application and file a fresh one within five days, citing the risk of losing his job. The State, through its counsel, did not oppose the withdrawal and agreed to cooperate for an early disposal of the fresh application. The High Court granted leave to withdraw the bail application and directed that a fresh bail application be filed within five days, with the trial court ordered to dispose of it within fifteen days of the first hearing. Consequently, the bail application No. 845 of 2026 was marked as withdrawn.
