The Court granted leave to withdraw the bail application, allowing the applicant to file a fresh application later under the specified conditions.
Summary
The applicant, Yuvraj Ravsaheb Mali, sought bail for offences under Sections 103(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. While the bail application was pending, the applicant’s counsel requested permission to withdraw it and file a fresh bail application later, either upon a change in circumstances or after one year if the trial showed no progress. The State’s counsel did not oppose the withdrawal. The Court, after hearing the counsel, granted leave to withdraw the present bail application with liberty to file a fresh one under the stipulated conditions. The Court directed that any future application be considered on its own merits. Consequently, the bail application was formally disposed of as withdrawn.
