Bombay High Court

MAHARASHTRA KRISHNA VALLEY DEVELOPMENT CORPORATIONversusTHE STATE OF MAH and ANR

Disposal
DISMISSED

Holding

The appeal is dismissed as the compensation awarded is within four times the SLAO award and there is no ground for intervention.

Summary

Maharashtra Krishna Valley Development Corporation appealed the 1994 award of the Reference Court which had granted compensation up to four times the amount awarded by the State Land Acquisition Officer (SLAO). The appellant argued that the award exceeded the permissible limit. The State Government, through a series of resolutions (dated 03.11.2016, with corrigenda on 23.02.2017 and 13.08.2018), had decided not to challenge the reference award provided the compensation did not exceed four times the SLAO award. The High Court examined whether there was any ground to intervene in the award and concluded that the compensation was within the four‑times ceiling. Consequently, the Court dismissed the appeals and ordered the disposal of the pending civil applications.

Issues considered

  • Whether the compensation awarded by the Reference Court exceeds the statutory limit of four times the SLAO award.
  • Whether the High Court has jurisdiction to intervene in the Reference Court's award under the given circumstances.

Subjects

  • compensation
  • land acquisition
  • reference court award
  • four times rule
  • state government resolution

P. C.:

1. Heard the learned counsel for the Appellant.

2. By this appeal, the appellant assails the judgment and award dated

18.06.1994 passed by the Reference Court in L.A.R. Nos.26/1992, 341/1993

and 266/1992.

3. Learned counsel submit that the compensation granted by the learned

Reference Court is within four times the compensation granted by the SLAO.

4. In fact the State Government vide Government Resolution

No.Sankirna-2014/Prak.Kra.4/Bham-1/A-4 dated 03.11.2016 with

Corrigendum dated 23.02.2017 and 13.08.2018 to the said Government

enhanced only upto four times.

5. Therefore, I do not find any reason to intervene with the impugned

award. Hence, the present Appeals are dismissed.

6. In view of dismissal of the Appeals, pending Civil Applications, if any,

do not survive and are disposed of accordingly.
