The Court held that the applicants may withdraw their proportionate share of the 13% amount deposited by the acquiring body.
Summary
The applicants, representing the estate of the deceased Tukaram Tatya Raut and his heirs, filed applications seeking to withdraw their share of money deposited by the acquiring body. The High Court had earlier ordered the acquiring body to deposit 50% of the total amount awarded, but only 13% of that amount was actually deposited. The applicants requested permission to withdraw their proportionate share from the deposited amount. The Court noted a prior similar case where claimants were allowed to withdraw the same 13% without any conditions. Accordingly, the Court allowed the applicants to withdraw their proportionate share of the 13% deposited. The civil applications were therefore disposed of in favor of the applicants.
