Admitted/Allowed/Granted/Rule Absolute

Holding

The Court allowed the amendment of the appeal’s title clause and permitted the claimants to withdraw the deposited amount with interest.

Summary

During the pendency of a first appeal, the appellant Smt. Indubai Govinda Kapade died, prompting her legal representatives to file Civil Application No.10156/2026 seeking amendment of the appeal's title clause to include the new representatives. The Court allowed the amendment, directing the appellant to incorporate the names of applicants 1A to 1D and quashing any abatement. In a separate Civil Application No.10157/2026, the land‑losers whose property had been compulsorily acquired petitioned to withdraw the balance amount, with interest, that the acquiring body had deposited with the Court. Relying on a prior order in Civil Application No.8458/2026, the Court permitted the withdrawal upon furnishing a standard undertaking. Both applications were consequently allowed and disposed. The orders ensure procedural continuity of the appeal and facilitate the claimants' access to compensation funds.

Issues considered

  • Whether the title clause of a pending first appeal may be amended to reflect the death of the appellant and the substitution of legal representatives.
  • Whether claimants can withdraw the balance amount, with interest, deposited by the acquiring body in the Court.
