The court allowed the amendment of the appeal title, condoned the delay, permitted withdrawal of 75% of the deposited award with conditions, and made the stay of execution absolute.
Summary
The applicants, legal representatives of the deceased claimant Bajrang Tukaram Godase, sought to amend the title of a First Appeal to reflect their status after his death and requested condonation of a 1506‑day delay in filing the application. The court allowed the amendment, condoned the delay, and directed the appellants to incorporate the representatives' names in the appeal. In a subsequent application, the applicants sought to withdraw 75% of the award amount deposited by the acquiring body, citing a prior similar order, and the court permitted the withdrawal subject to an undertaking, directing the remaining 25% to be kept in a fixed deposit. Another application sought a stay of execution of the award, and the court made the earlier stay absolute. All applications were allowed and disposed of accordingly.
Issues considered
- Whether a delay of 1506 days in filing an application to amend the title of an appeal can be condoned.
- Whether the legal representatives of a deceased claimant can be added to the appeal as parties.
