Bombay High Court
EX. ENGINEER, MINOR IRRIGATION DIV. PARBHANI UNDER G.M.I.D.C, AURANGABAD AND ORSversusDYANOBA DATTU MUNDE AND ORS
- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
A short, non‑deliberate delay of seven days in filing the first appeal is condonable, and the first appeals are to be registered.
Summary
The acquiring body, represented by the Ex. Engineer of the Minor Irrigation Division, filed first appeals against a judgment and award dated 27‑11‑2019 in three land‑acquisition references. The appeals were lodged seven days after the statutory deadline, and the applicants sought condonation of this delay, arguing it was neither deliberate nor negligent. The court considered a recent Supreme Court decision (Sheo Raj Singh v. Union of India, Civil Appeal No. 5867 of 2015) where a much longer delay was condoned, and found the reasons for the seven‑day lapse satisfactory. Consequently, the High Court condoned the delay, ordered the first appeals to be registered, confirmed the interim relief as the full compensation had been deposited, and disposed of the pending civil applications.
Issues considered
- Whether a seven‑day delay in filing a first appeal against a land‑acquisition award can be condoned.
- Whether the Supreme Court precedent in Sheo Raj Singh v. Union of India is applicable to a shorter delay.
- Whether the interim relief granted earlier should remain in force after condonation of delay.
