- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
A seven‑day delay in filing the first appeals is not deliberate or negligent and is therefore condoned, permitting registration of the appeals.
Summary
The acquiring authority, represented by Ex. Engineer, Minor Irrigation Division, Parbhani, filed first appeals against a judgment and award dated 27‑11‑2019 of the Civil Judge, Senior Division, Gangakhed in three land‑acquisition references. The appeals were filed seven days after the prescribed period, and the applicants pleaded that the delay was neither deliberate nor negligent. The Court examined the Supreme Court’s decision in Sheo Raj Singh v. Union of India (Civil Appeal No. 5867 of 2015) which upheld condonation of delay in similar circumstances. Finding the reasons for the seven‑day delay satisfactory, the Court condoned the delay and ordered that the first appeals be registered. It also confirmed the interim relief previously granted, noting that the full compensation had been deposited, and disposed of the pending civil applications.
Issues considered
- Whether a delay of seven days in filing a first appeal against a land‑acquisition award can be condoned.
- Whether the Supreme Court precedent in Sheo Raj Singh v. Union of India is applicable to the present case.

- delay condonation
