Bombay High Court
EX. ENGINEER, MINOR IRRIGATION DIV. PARBHANI UNDER G.M.I.D.C, AURANGABAD AND ORSversusSANDIP MUKUNDRAO MUNDE
- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
The Court condoned the seven‑day delay, ordered registration of the first appeals, and confirmed the interim relief.
Summary
The acquiring authority, aggrieved by a judgment and award dated 27‑11‑2019 in three land‑acquisition references, filed first appeals after a seven‑day delay. The authority sought condonation of the delay, arguing it was neither deliberate nor negligent, and cited a Supreme Court decision (Sheo Raj Singh v. Union of India, 2023) that upheld condonation of a 479‑day delay in a similar context. The High Court examined the reasons for the delay and, finding no prejudice, allowed the condonation and ordered the registration of the first appeals. It also noted that the entire compensation amount had been deposited with the Court, thereby confirming the interim relief previously granted. All the pending civil applications were subsequently disposed of.
Issues considered
- Whether a delay of seven days in filing a first appeal against a land‑acquisition judgment can be condoned.
- Whether the Supreme Court precedent on condoning delay is applicable to the present case.
- Whether the interim relief granted earlier should continue after the depositing of full compensation.
