Summary

The State of Maharashtra filed a civil application challenging a judgment and award dated 18 November 2022 passed by the Civil Judge Senior Division, Omerga. The State sought condonation of a 1,326‑day delay in filing its first appeal, arguing that the reasons for the delay were satisfactorily explained. The respondent opposed condonation, but the High Court accepted the explanation and condoned the delay. The Court also entertained a stay application, ordering that the impugned judgment be stayed provided the State deposits the entire award amount within twelve weeks. Notice was issued to the respondent, who waived service, and the civil application for condonation and stay was disposed accordingly.
