BABU RANGA MORE (DIED) THR LRS ATMARAM AND ORSversusTHE SUB DIVISIONAL OFFICER PACHORA DIV. PACHORA DIST JALGAON

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The court condoned the 324‑day delay in filing the cross‑objection.

Summary

The petitioners filed a civil application seeking condonation of a 324‑day delay in filing a cross‑objection. The delay was explained in the petition, and the court noted that the main First Appeal by the acquiring body was already pending and admitted. Considering these circumstances, the court found the delay deserving of condonation. Accordingly, the application was allowed and the delay was condoned. The court further directed the petitioners to remove all office objections within four weeks, otherwise the order would lapse, and held that even if the cross‑objection is allowed, the petitioners would not be entitled to interest or statutory benefits for the delayed period.

                                             CORAM : AJIT B. KADETHANKAR, J.
                                             DATED : 11th September 2026

                     P.C. :-

. This Civil Application is filed seeking condonation of

delay of 324 days caused in filing the cross-objection.

                     2. The delay is well explained in paragraph Nos.2 to 6 of

the application. Considering that the main First Appeal filed

by the acquiring body is pending in this Court and is already

admitted, the delay deserves to be condoned.

                     3. For the reasons stated in the application, the same is

allowed. Delay of 324 days caused in filing the cross-objection

                     stands condoned.

                                               936 CA 10591 OF 2026

4. The applicants shall remove all the office objections

within a period of four weeks from today. If the objections are

not removed within stipulated period, this order shall

automatically lose its effect.

5. Suffice to note, in the event the cross objection is

allowed, the applicants shall not be entitled for interest and

statutory benefits for the delayed period.
