- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
The Registrar’s order dismissing the cross‑objections is quashed and the cross‑objections are restored subject to removal of office objections within four weeks.
Summary
The applicants filed multiple civil applications seeking restoration of cross‑objections that had been dismissed by the Registrar for failure to remove office objections within the prescribed time. They argued that the delay should be condoned and the Registrar’s order set aside. The Court examined whether the Registrar’s dismissal could be reversed despite the procedural lapse. It held that the Registrar’s order was quashed, the cross‑objections restored, and the applicants were given four weeks to clear the outstanding office objections, with a warning that the order would lapse if they failed to do so. The Court also clarified that no interest or statutory benefits would accrue for the period of delay.
Issues considered
- Whether the Registrar’s order dismissing the cross‑objections for failure to remove office objections can be set aside.
- Whether the delay in filing the cross‑objections can be condoned.
- What conditions, if any, should be imposed on the restoration of the cross‑objections.
Subjects
- restoration of cross‑objections
- condonation of delay
- civil procedure
- registration of objections
- court order quash
- interest and statutory benefits
