Bombay High Court

BALAJI ATMARAM MULKE DIED THR L.RS. PARMESHWAR BALJAI MULKE AND ORS.versusTHE STATE OF MAHARSHTRA THR., THROUGH COLLECTOR LATUR AND ORS.

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The Court set aside the Registrar's dismissal and restored the cross‑objections, subject to the applicants removing all office objections within four weeks.

Summary

The applicants filed multiple civil applications seeking restoration of cross‑objections that had been dismissed by the Registrar for failing to remove office objections within the prescribed time. The Registrar's order was challenged on the ground that the delay in filing the cross‑objections could be condoned. The Court examined whether the Registrar's dismissal could be set aside and whether the applicants could be permitted to file the cross‑objections after the lapse of time. It held that the delay, if any, was condonable and quashed the Registrar's order, restoring the cross‑objections to their original position. The restoration was made conditional on the applicants removing all office objections within four weeks, failing which the order would lapse, and the Court clarified that no interest or statutory benefits would be payable for the delayed period.

Issues considered

  • Whether the Registrar's order dismissing the cross‑objections can be set aside.
  • Whether delay in filing cross‑objections can be condoned under the applicable procedural law.
  • What conditions, if any, should be imposed on the restoration of the cross‑objections.

Subjects

  • restoration of cross‑objections
  • condonation of delay
  • registrar order
  • civil procedure
  • interest and statutory benefits

CIVIL APPLICATIONS FOR RESTORATION

. Mr. S. R. Bagal, learned Advocate for the

applicants/claimants submits that the registration of the cross-

to remove office objections within the stipulated time. The

present applications are filed seeking restoration of the cross-

objections by setting aside the said order of dismissal.

allowed. The delay, if any, caused in filing the cross-objections

stands condoned. The order passed by the learned Registrar

position, provided that the applicants shall remove all office

objections within a period of four weeks from today.

4. It is made clear that if the office objections are not

removed within the stipulated period, this order shall

automatically lose its effect.

5. It is clarified that if the cross-objections are allowed, the

applicants shall not be entitled to interest and statutory

benefits for the delayed period.
