Holding

The claimants are permitted to withdraw the entire amount deposited by the Acquiring Body, together with accrued interest, upon furnishing a satisfactory undertaking.

Summary

The High Court of Bombay, Aurangabad Bench, entertained a slew of civil applications seeking withdrawal of amounts deposited by the Acquiring Body under a prior order dated 02.05.2024. That earlier order required the Acquiring Body to deposit fifty percent of the compensation award within twelve weeks, but only thirteen percent of the stipulated amount was actually deposited. The claimants filed applications to withdraw the deposited sum along with accrued interest, subject to furnishing a standard undertaking. The Court held that, given the partial compliance, the claimants were entitled to withdraw the entire amount that had been deposited, together with interest, upon furnishing the required undertaking. Consequently, all the listed civil applications were disposed of, with a few specific applications earmarked for further consideration after three weeks. The order underscores the Court’s enforcement of compliance with its earlier directives and the entitlement of claimants to recover deposited sums with interest.

Issues considered

  • Whether the claimants are entitled to withdraw the amount deposited by the Acquiring Body despite only partial compliance with the Court’s earlier order
  • Whether interest is payable on the deposited amount
  • Whether the claimants must furnish an undertaking to the satisfaction of the Registrar before withdrawal

Subjects
