Holding

Claimants are entitled to withdraw the entire amount deposited by the Acquiring Body, together with accrued interest, upon furnishing a satisfactory undertaking to the Registrar.

Summary

The High Court of Bombay, Aurangabad Bench, entertained a slew of civil applications seeking withdrawal of compensation amounts that had been partially deposited by the Acquiring Body following a prior order directing 50% of the award to be paid within 12 weeks. The Acquiring Body deposited only 13% of the stipulated 50%, prompting the claimants to apply for withdrawal of the deposited sum. The Court examined whether the claimants could retrieve the deposited amount along with accrued interest, subject to procedural safeguards. It held that, given the partial deposit, the claimants were entitled to withdraw the entire deposited amount with interest, provided they furnished a standard undertaking satisfactory to the Registrar (Judicial). Consequently, all the civil applications were disposed of, with a few listed for further consideration after three weeks.

Issues considered
