Holding

The claimants are entitled to withdraw the entire amount deposited by the Acquiring Body, together with accrued interest, subject to furnishing the usual undertaking to the Court.

Summary

The High Court of Bombay, Aurangabad bench dealt with a series of civil applications seeking withdrawal of amounts deposited by the Acquiring Body under a prior order dated 02.05.2024. That order required the Acquiring Body to deposit 50% of the compensation award within twelve weeks, but only 13% of the stipulated amount was actually deposited. The claimants filed applications to withdraw the deposited sum along with accrued interest, subject to furnishing a standard undertaking. The Court held that, given the partial compliance, the claimants are entitled to withdraw the entire amount that has been deposited, together with interest, upon providing the required undertaking. The applications were consequently disposed of, and a few specific applications were listed for further consideration after three weeks. The order underscores the Court’s enforcement of its earlier directive and the entitlement of claimants to recover deposited funds with interest.

Issues considered

  • What entitlement do claimants have to withdraw amounts deposited by the Acquiring Body under the Court’s earlier order?
  • Is the Acquiring Body’s partial deposit sufficient to trigger the claimants’ right to withdraw the entire deposited sum with interest?
  • What conditions, if any, must the claimants satisfy to effect the withdrawal?

Subjects

  • withdrawal of compensation
  • civil application
  • Acquiring Body
  • interest on deposited amount
  • Court order compliance
  • partial deposit
