The claimants are entitled to withdraw the entire amount deposited by the Acquiring Body, together with accrued interest, upon furnishing the requisite undertaking to the Registrar.
Summary
The High Court of Bombay, Aurangabad Bench, entertained a series of civil applications seeking withdrawal of amounts deposited by the Acquiring Body under a prior order dated 02.05.2024, which mandated the deposit of 50% of compensation within twelve weeks. The Acquiring Body had deposited only 13% of the stipulated 50%, prompting the claimants to file applications for withdrawal of the deposited sum. The Court examined the compliance with its earlier directive and the claimants' entitlement to the deposited amount along with accrued interest. It held that the claimants could withdraw the entire amount deposited, provided they furnish the usual undertaking satisfactory to the Registrar (Judicial). Consequently, all the civil applications were disposed of, with a few listed for further consideration after three weeks.
Issues considered
- Whether the claimants are entitled to withdraw the amount deposited by the Acquiring Body under the earlier court order
- Whether interest is payable on the deposited amount
- Whether the claimants must furnish an undertaking to the Registrar before withdrawal
Subjects
- withdrawal of compensation
- civil application
- deposit compliance
- interest on deposited amount
- Acquiring Body
