Holding
The court held that the claimants may withdraw the entire deposited amount with interest, subject to furnishing the usual undertaking to the Registrar.
Summary
The applicants filed multiple civil applications seeking withdrawal of compensation amounts that had been partially deposited by the Acquiring Body following a prior court order directing 50% payment within 12 weeks. The Acquiring Body deposited only 13% of the mandated amount, prompting the claimants to request withdrawal of the deposited sum with accrued interest. The court examined the compliance with its earlier order and determined that the claimants are entitled to withdraw the entire deposited amount, provided they furnish the usual undertaking to the Registrar. The court ordered that the applications be disposed of, allowing withdrawal subject to the undertaking. It also listed a few specific applications for further consideration after three weeks.
Issues considered
- Whether the claimants are entitled to withdraw the amount deposited by the Acquiring Body under the earlier order
- Whether the court may condition the withdrawal on the filing of an undertaking
Subjects
- civil procedure
- withdrawal of amount
- compensation award
- court order compliance
- interest on deposited amount
