THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND ORSversusTATYARAO DADARAO JADHAVAR AND ORS

Disposal
DISPOSED OFF

Holding

The Court modified the order to reduce the deposit amount to Rs.1,13,36,615, reflecting the entitlement of the petitioners.

Summary

The State of Maharashtra filed a civil application seeking modification of the order dated 07.05.2026 in Writ Petition No. 4647/2026, requesting that the amount to be deposited be reduced from Rs.1,50,00,000 to Rs.1,13,36,615. The Court examined the award and found that the original petitioners were entitled only to Rs.1,13,36,615, with the remaining balance belonging to a non‑applicant, Suryabhan Nivrutti Jadhavar, who had not approached the Court. Accordingly, the Court modified the impugned order to permit the State to deposit the lower amount. The civil application was allowed, and the writ petition was disposed as the petitioners could now withdraw the entitled sum. The decision rests on the factual entitlement shown in the award and the Court’s power to amend its own orders in the interest of justice.

Issues considered

  • What is the correct amount that the State of Maharashtra is liable to deposit as per the award?
  • Can the Court modify its earlier order in the writ petition to reflect the actual entitlement of the petitioners?
