The court restored the writ petition, reinstated the interim stay, and condoned the delay in filing the restoration application.
Summary
The petitioners, Balaji Dhondiram Gavhane and another, sought restoration of their writ petition (No. 1917/2026) after it was dismissed for failure to bring on record the legal heirs of Defendant No. 4, Raosaheb Pundalik Gavane. The dismissal was based on a deadline set by the court, which the petitioners missed while trying to obtain the death certificate and other documents. They filed a civil application for restoration, explaining the delay and requesting reinstatement of the interim stay that had been granted against an order of the Civil Judge appointing a court commissioner for land measurement. The court examined whether the delay could be condoned and whether the interim relief should be revived. Finding the petitioners' explanation satisfactory, the court allowed the application, condoned the delay, ordered notice to the heirs, and restored the writ petition with the earlier interim stay, also awarding costs to the respondents.
Issues considered
- Whether the dismissal of the writ petition for non‑production of legal heirs can be set aside despite the delay.
- Whether the interim stay granted earlier should be reinstated.
- Whether the court may condone the delay in filing the application for restoration and in bringing the heirs on record.

on account of the various defects as stated by the Applicants in paragraph
