Bombay High Court

RAVAN SATAPPA MOREversusTHE STATE OF MAHARASHTRA, THROUGH COLLECTOR, OSMANABAD AND ANR.

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The court condoned the delay, quashed any abatement, and allowed the amendment of the First Appeal to include the legal representatives of the deceased claimant.

Summary

The original claimant, Ravan Satappa More, died while a First Appeal challenging a 2011 compensation award in a land acquisition case was pending. The legal representatives filed a civil application, after a delay of 1,229 days, seeking to be impleaded in the appeal and to amend the title clause to reflect their status. The court examined whether such a delay could be condoned and whether any abatement of the appeal should stand. It held that the delay was condoned, the abatement was quashed, and the representatives were permitted to amend the appeal within four weeks. Consequently, the civil application was disposed in favour of the applicants.

Issues considered

  • Whether the delay of 1,229 days in filing the civil application can be condoned.
  • Whether the abatement of the First Appeal, if any, should be set aside.
