The court condoned the delay and permitted the cross‑objections to be registered.
Summary
The applicants filed multiple civil applications seeking condonation of a 1,538‑day delay in filing cross‑objections to first appeals filed by the acquiring body. The applicants argued that the merit of the reference court's award was under challenge and that filing cross‑objections, rather than separate first appeals, was a statutory right to seek enhanced compensation. They further offered to waive statutory benefits and interest for the delayed period, asserting that no prejudice would be caused to the respondents. The court issued notice waivers for the respondents and, after considering the submissions, allowed the applications. Consequently, the delay was condoned and the cross‑objections were ordered to be registered.
Issues considered
- Whether a delay of 1,538 days in filing cross‑objections to first appeals can be condoned.
- Whether cross‑objections may be filed in lieu of separate first appeals without prejudice to the respondents.
