Holding
The court condoned the delay and allowed the registration of the cross‑objections.
Summary
The applicants filed multiple civil applications seeking condonation of a 1538‑day delay in filing cross‑objections to first appeals filed by the acquiring body concerning compensation awards. They argued that the merit of the reference court’s judgment is under challenge and that claimants have a statutory right to seek enhancement of compensation, so filing cross‑objections instead of separate appeals would not prejudice the respondents. The respondents, represented by various AGPs, waived notice. The bench considered whether such a lengthy delay could be condoned without causing prejudice. Finding no prejudice and noting the applicants’ willingness to waive statutory benefits and interest, the court allowed the applications, condoned the delay, and ordered that the cross‑objections be registered. The order permits the cross‑objections to be heard on merit.
