Holding
The court condoned the delay and ordered that the cross‑objections be registered.
Summary
The petitioners filed applications seeking condonation of delay in filing cross‑objections to the first appeals filed by the acquiring body concerning compensation awards. They argued that seeking enhanced compensation is a statutory right and that the cross‑objections should be heard on merit without prejudice to the respondents, even offering to waive interest and statutory benefits for the delayed period. The court examined whether the delay could be condoned and whether the cross‑objections could be registered despite the lapse. Finding no substantive prejudice and accepting the petitioners' submissions, the court allowed the applications, condoned the delay, and ordered that the cross‑objections be registered. Consequently, the procedural hurdle was removed, enabling the merits of the cross‑objections to be adjudicated.
