Bombay High Court
BALBHIM BHAGURAM KAMBLE.versusTHE STATE OF MAHARASHTRA THR COLLECTOR, LATUR AND ORS.
- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
The court condoned the delay and ordered that the cross‑objections be registered.
Summary
The applicants filed multiple civil applications seeking condonation of delay in filing cross‑objections to first appeals filed by the acquiring body concerning compensation awards. They argued that seeking enhanced compensation is a statutory right and that filing cross‑objections, rather than separate appeals, would not prejudice the respondents. The court was asked to waive notice for the State and the acquiring body and to consider the delay condoned. The bench, after hearing counsel, held that the delay in filing the cross‑objections was excusable and allowed the applications. Consequently, the cross‑objections were registered and notice was waived for the respondents.
Issues considered
- Whether the delay in filing cross‑objections to the first appeals can be condoned.
- Whether the statutory right to seek enhanced compensation justifies filing cross‑objections instead of separate appeals.

- condonation of delay
- cross‑objections
