Bombay High Court
SHYAMRAO SIDRAM PATIL.versusTHE STATE OF MAHARASHTRA THR COLLECTOR, LATUR AND ORS.
- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
The Court condoned the delay and allowed the registration of the cross‑objections.
Summary
The petitioners filed civil applications seeking condonation of delay in filing cross‑objections to first appeals filed by the acquiring body concerning compensation awards. They argued that seeking enhanced compensation is a statutory right and that filing cross‑objections, rather than separate appeals, would not prejudice the respondents. The respondents, including the State of Maharashtra and the acquiring body, waived notice. The Court examined whether the delay could be excused and whether the cross‑objections could be registered. Finding no prejudice and noting the petitioners’ willingness to waive interest, the Court condoned the delay and ordered that the cross‑objections be registered and notice issued. Consequently, the applications were allowed.
Issues considered
- Whether the delay in filing cross‑objections to the first appeals can be condoned under civil procedure rules
- Whether cross‑objections filed after the prescribed period may be registered without prejudice to the respondents
