Bombay High Court

DNYANESHWAR SHIVAJI PAWARversusTHE STATE OF MAHARASHTRA THROUGH ITS DISTRICT AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is infructuous because the Gram Panchayat’s term has expired, and therefore no relief can be granted.

Summary

Vishnu Nivrutti Koli filed a writ petition challenging the order that disqualified him from the post of Sarpanch. The petitioner argued that the disqualification was illegal. The court observed that the term of the Gram Panchayat had already expired on 10 February 2026, leaving no operative issue to adjudicate. Since the subject matter no longer existed, the petition was deemed infructuous. Consequently, the writ petition and any pending civil applications were dismissed.

Issues considered

  • The order of disqualification of the petitioner from the post of Sarpanch is challengeable.
  • Whether the petition remains maintainable given the expiration of the Gram Panchayat's term.

PER COURT :

1. This matter is circulated by the respondent. According to the
respondent No. 3, the order of disqualification for the post of Sarpanch is
the subject matter of challenge in the present Writ Petition. But
considering the term of office of the Grampanchyat itself is over on
10.02.2026. Therefore, nothing survives to be adjudicated in the present
Writ Petition and this position is not disputed by the learned Advocate for
the petitioner.

2. In view thereof, the Writ Petition is disposed of as
infructuous.

3. In view of disposal of the Writ Petition the pending all Civil
Applications, if any, are also disposed of.
