- Disposal
- DISPOSED OFF
Holding
The court allowed the amendment, condoned the delay, dismissed the unmaintainable application, and held the injunction application infructuous due to the transfer of the property.
Summary
The High Court considered four civil applications arising from a suit concerning agricultural land. It allowed the amendment to add a subsequent purchaser to the second appeal and directed that the amendment be effected within two weeks, with notice to the proposed respondent No.3. The court condoned a 100‑day delay in filing the second appeal and disposed of that application. It dismissed an application for which no decree had been passed against the applicant as unmaintainable. Finally, the application for a temporary injunction was held infructuous because the suit property had already been transferred to the proposed respondent No.3, and the matter was disposed.
Issues considered
- Whether the amendment to add a subsequent purchaser to the second appeal may be permitted.
- Whether a delay of 100 days in filing the second appeal can be condoned.
- Whether an application is maintainable when no decree has been passed against the applicant.
- Whether a temporary injunction can be granted when the suit property has been transferred to another party.
