Bombay High Court

GANGA RAGHU KHADKE AND ORSversusTHE STATE OF MAHARASHTRA THR COLLECTOR, AHMEDNAGAR AND ORS

Disposal
PARTLY ALLOWED AND PARTLY DISMISSED

Holding

The applications are allowed as the legal heirs are already recorded in the State's appeals, and the amendment may be made within one week.

Summary

The claimants filed a series of civil applications seeking to have the legal heirs and representatives of the deceased, Parvatabai Kusa Gudnar, placed on record in the appeals filed by the State of Maharashtra. The State had already listed these heirs in its own appeals, raising the question of whether the claimants' applications required further scrutiny. The Court examined the procedural record and found that the names were already on file, rendering the claimants' request merely a formal amendment. Consequently, the Court allowed the applications, directing that the amendment be effected within one week. The applications were thereafter disposed of. The judgment underscores the Court's approach to procedural efficiency in civil proceedings.
