BABARAO NAGORAO JADHAV DIED THRO. L.RS. BALWANT BABARAO JADHAVversusM.I.D.C. A CORPORATE BODY THROUGH DIVISI.OFFICER,LATUR
- Disposal
- DISMISSED
Holding
The Court adopts the view expressed in First Appeal No. 694 of 2004 and dismisses the present appeals and pending civil applications.
Summary
The appeals arise from land acquisition proceedings initiated in 1993 for the establishment of a MIDC at Latur. The appellants challenged three earlier judgments and awards dated 27‑02‑2004, 19‑01‑2004 and 17‑06‑2006 that determined compensation for the acquired land. The Court noted that a prior decision in First Appeal No. 694 of 2004, dealing with the same acquisition, had already settled the legal issues. Relying on that precedent, the Court adopted the same view for the present appeals. Consequently, all three appeals and the pending civil applications were dismissed.
Issues considered
- Whether the earlier judgments and awards in the 1993 MIDC acquisition should be upheld.
- Whether the legal reasoning in First Appeal No. 694 of 2004 is applicable to the present appeals.
- Whether the appeals and associated civil applications ought to be dismissed.
