PANDU BHORU KHADKE AND ORSversusTHE STATE OF MAHARASHTRA THR COLLECTOR, AHMEDNAGAR AND ORS

Disposal
DISPOSED OFF

Holding

Since the legal heirs were already recorded in the State's appeals, the claimants' applications to bring them on record are allowed.

Summary

The claimants filed multiple civil applications seeking to have the legal heirs/representatives of the deceased brought on record in the appeals filed by the State of Maharashtra. The court examined whether such amendment could be permitted. It observed that the names of the legal heirs were already recorded in the State's appeals, rendering the claimants' request permissible. Consequently, the applications were allowed and the parties were directed to effect the amendment within one week. The applications were thereafter disposed.
