The Court allowed the application, condoned the delay, recalled the abatement order, and permitted amendment of the writ petition to include the legal representatives.
Summary
The original writ petition filed by the late Sadashiv Vyankati Kadam was abated after his death. The legal representatives of the deceased sought to be added to the petition but filed the application for amendment and condonation of delay after the prescribed time, claiming they were unaware of the pending petition. The respondents opposed, alleging the delay was deliberate. The High Court examined whether the delay could be condoned and whether the abatement order could be recalled. Finding no deliberate intent and in the interest of justice, the Court allowed the application, condoned the delay, recalled the abatement order, and permitted the amendment of the writ petition to include the legal representatives within two weeks, subject to a cost.
Issues considered
- Whether the delay in filing the application for amendment and condonation of delay is condonable.
