Summary

The applicant, Kamalbai (representing the estate of the deceased), filed a civil application seeking condonation of a 1,341‑day delay in filing an appeal against the State of Maharashtra and others. The primary issue was whether such a lengthy delay could be condoned by the High Court. The Court examined the explanation provided by the applicant and considered the principles of equity and procedural fairness. It decided to condone the delay but imposed a condition that the applicant must undertake not to claim any statutory benefits or interest for the period of delay. The undertaking was to be filed within six weeks. Accordingly, the civil application was allowed and the matter disposed of.
