Holding
The court condoned the delay, allowed the legal representatives to be added to the appeal, and permitted withdrawal of the deposited amount with interest.
Summary
The appellant's first appeal was dismissed for delay, after which the sole respondent died. The legal representatives of the deceased filed Civil Application No. 2656 seeking to be brought on record and to condone a 1,120‑day delay in filing the application. The court considered whether such a lengthy delay could be condoned and whether the representatives could be added to the appeal. It held that the delay was condoned and ordered that the representatives' names be incorporated in the first appeal. In a subsequent Civil Application No. 2654, the same representatives sought permission to withdraw the amount deposited by the appellant/acquiring body, together with accrued interest. The court found no impediment and allowed the withdrawal, disposing both applications in the appellant's favour.
