Holding
The court allowed both civil applications, condoned the delay, and permitted the withdrawal of the deposited amount with interest.
Summary
The petitioners, legal representatives of a deceased claimant, filed Civil Application No. 2660 seeking condonation of a 1,120‑day delay in bringing the deceased's representatives on record after the first appeal had been dismissed. The court allowed the application, condoned the delay, and directed the appellant to amend the appeal to include the petitioners as legal representatives. Subsequently, in Civil Application No. 2659, the same petitioners sought permission to withdraw the amount deposited by the appellant/acquiring body in the court, along with accrued interest. The court found no impediment and permitted the withdrawal, ordering the amount to be returned with interest. Both applications were therefore allowed and disposed of.

- Whether a delay of 1,120 days in filing a civil application to bring legal representatives of a deceased claimant on record can be condoned.
