Bombay High Court

Bhagwat Ambadas GaikwadversusThe State of Maharashtra Through Collector Osmanabad At Osmanabad

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The court allowed the applicants to withdraw 50% of the deposited amount with interest upon an undertaking and an additional 25% upon furnishing a satisfactory surety or security.

Summary

The applicants, Bhagwat Ambadas Gaikwak and another, filed a civil application seeking withdrawal of the amount deposited by the acquiring body, which had paid 75% of the compensation awarded by a reference court. The applicants relied on a prior similar application where the court permitted withdrawal after deposit. The court, noting its earlier order dated 25-06-2026 and the precedent, allowed the withdrawal on specified terms: 50% of the deposited amount with accrued interest upon furnishing a usual undertaking, and an additional 25% upon furnishing a satisfactory solvent surety or security. The remaining portion remains subject to the stay order pending disposal of the appeal. The application was therefore allowed.
