Holding

The Court condoned the delay and ordered registration of the first appeals.

Summary

Three civil applications were filed in the Bombay High Court seeking condonation of substantial delays—588, 630 and 639 days—in filing first appeals against orders of the State of Maharashtra. The applicants, represented by Shri A. P. Nahar and Shri Anand P. Bhandari, explained the reasons for the delay in paragraphs 7 and 8 of their applications. The respondents, the State of Maharashtra and others, were represented by various advocates including Mrs. Dr. Kalplata B. Patil Bharaswadkar and Mrs. V. S. Choudhari. The Court examined whether the explanations justified condoning the delay under the principles of equity and procedural fairness. Finding the explanations satisfactory, the Court held that the delay deserved condonation. Consequently, the applications were allowed, the delays were condoned, and the first appeals were ordered to be registered.
