Summary

The Executing Engineer of the Upper Pravara Project sought a conditional stay of proceedings against the respondents. The acquiring body deposited the amount ordered by the Court on 31 August 2026, complying with the order dated 30 March 2026. The Court confirmed the conditional stay on the basis of this deposit. Separate civil applications were filed to condone delay in filing appeals, as respondent No.2 failed to appear despite being served. The acquiring body satisfactorily explained the reasons for delay, which were found to be neither intentional nor deliberate. Consequently, the Court allowed the applications for stay and for condonation of delay and disposed of them.
