Holding

The court confirmed the conditional stay and allowed both the civil applications for stay and for delay, condoning the delay.

Summary

The Executing Engineer of the Upper Pravara Irrigation Project sought enforcement of a conditional stay after the acquiring body deposited the amount as directed by the court on 31‑08‑2026, following an order dated 30‑03‑2026. The court confirmed the conditional stay and allowed the civil applications for stay, disposing of them. It noted that Respondent No.2, though served, did not appear. The acquiring body explained the reasons for delay in filing appeals, which the court found to be non‑intentional and therefore condoned. Consequently, the civil applications for delay were also allowed and disposed.

Issues considered

  • Whether the conditional stay granted earlier should be confirmed after the required amount was deposited.
  • Whether the delay in filing the appeals can be condoned.
  • Whether the civil applications for stay and for delay should be allowed.

Subjects

  • conditional stay
