Holding

The conditional stay is confirmed and the delay in filing the appeals is condoned, resulting in the disposal of the civil applications.

Summary

The Executing Engineer of the Upper Pravara Irrigation Project filed multiple civil applications seeking a stay and condonation of delay in proceedings against Baban Chima Malunjkar and another. The Court had earlier directed the acquiring body to deposit a specified amount, which was deposited on 31 August 2026 as per the order dated 30 March 2026. On the basis of this deposit, the Court confirmed the conditional stay previously granted. The Court also examined the reasons for delay, found them to be non‑intentional, and consequently condoned the delay in filing the appeals. Both the civil applications for stay and for delay were allowed and disposed of, with the respondent failing to appear despite being served.
