THE EXECUTIVE ENGINEER LOWER TERNA PROJECT DIVISION NO 2 LATUR AND ORSversusARVIND MUDANNA MADE

Disposal
DISPOSED OFF

Holding

The court held that the parties' settlement, which accepts the Reference Court's compensation award and provides for interest and deposit, is binding and the First Appeals are disposed of accordingly.

Summary

The Executive Engineer (acquiring body) filed a series of First Appeals challenging awards of compensation granted by the Reference Court in land acquisition matters. The parties appeared before the National Lok Adalat, and after hearing, they reached an amicable settlement. The settlement confirms the compensation rates awarded by the Reference Court, provides for interest payable from the date of award, and requires the acquiring body to deposit any unpaid award amounts within eighteen months. It also stipulates that any excess amounts withdrawn by claimants be refunded, and that the settlement will not set a precedent for other cases. The Lok Adalat recorded the settlement, ordered issuance of court fee certificates, and disposed of all the First Appeals in accordance with the agreement.

Issues considered

  • The validity of the compensation award granted by the Reference Court
