Bombay High Court
RAJESHWAR PUNDLIKRAO.versusTHE STATE OF MAHARASHTRA THROUGH THE COLLECTOR NANDED AND ORS.
- Disposal
- Admitted/Allowed/Granted/Rule Absolute
Holding
The court condoned the delay in filing the first appeals, subject to the condition that the petitioners furnish an undertaking not to claim any statutory benefits or interest.
Summary
The petitioners filed multiple civil applications seeking condonation of substantial delays—ranging from 1,828 to 4,928 days—in filing their first appeals against orders of the State of Maharashtra. The court examined the explanations provided for the delays and found them satisfactory. Accordingly, the court exercised its discretion under the Civil Procedure Code to condone the delays. However, the condonation was conditioned upon the petitioners furnishing an undertaking to the Registrar (Judicial) that they would not claim any statutory benefits or interest. The undertaking must be filed within eight weeks from the date of the order. The applications were therefore allowed and disposed of.
Issues considered
- Whether the delay of 1,828 to 4,928 days in filing first appeals can be condoned under the Civil Procedure Code.
- Whether the petitioners' explanations constitute a satisfactory ground for condonation.
- Whether imposing a condition of an undertaking not to claim statutory benefits and interest is permissible.
