The Court granted a stay of the impugned judgment and decree, subject to conditions restricting any change, possession, third‑party rights, or development of the suit property.

Summary

The High Court of Bombay at Goa entertained a civil application (No.53/2026) seeking a stay of the judgment and decree dated 31‑01‑2026 in Civil Suit No.31/2008/II, which had set aside three sale deeds transferring the suit property to the appellant (original defendant). The appellant argued that staying the decree would allow it to develop or otherwise deal with the property pending appeal. The Court, considering the potential prejudice to the appellant and the need to preserve the status quo, granted a stay of the decree subject to strict conditions: the appellant may not alter the nature or status of the property, may not part with possession or create third‑party rights, and may not undertake any development on the property. The application was disposed of on these terms, effectively staying the operation of the impugned judgment until the appeal is decided.

Issues considered

  • Whether a stay of the judgment and decree dated 31‑01‑2026 should be granted pending the appeal
  • Whether conditions should be imposed on the appellant to preserve the status quo of the suit property

  • stay of decree
