Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The court permitted a partial withdrawal of 25% of the deposited compensation subject to an undertaking and security, and made the ad‑interim stay absolute.

Summary

The insurance company appealed against the compensation awarded by a tribunal and deposited the full amount as ordered by the court. The applicants filed a civil application seeking to withdraw a portion of the deposited compensation pending the appeal. The court, after noting that the tribunal had duly considered the parties' contentions, allowed a partial withdrawal of 25% of the amount upon furnishing an undertaking and a solvent security, with the balance to be kept in a fixed deposit for three years. The applicants were also required to give an undertaking that disbursement would be subject to the final outcome of the appeal. Additionally, the court made the earlier ad‑interim stay absolute as prayed, thereby staying any further execution of the amount. The first appeal was admitted and the hearing was expedited.

Issues considered

  • Whether the applicants are entitled to withdraw a portion of the compensation amount deposited by the insurer pending the outcome of the appeal.
  • Whether the court may impose conditions such as an undertaking and solvent security on the withdrawal.
  • Whether the ad‑interim stay granted earlier can be converted into an absolute stay.

  • withdrawal of compensation
  • insurance claim
  • civil application
  • stay of execution

5. Thus, the application is partly allowed. The applicants
